In light of the C&D received by Farscape Fantasy over the use of vidders' use of Enya's music, I have removed "Book of Days" (Harry Potter) from Drawn to the Rhythm, in an effort to cover my own arse.

*whinge* It's my best freaking vid, too, bloody hell.

Over the past year, I have often seriously considered password protecting DttR but was never able to get the whole shebang working properly through my host's built-in password protection. However, I'm going to make a much more determined effort to get that working. If anybody can point me in the right direction for learning how to do it, I would greatly appreciate it.

I need help deciding which vid to make next. I am equally torn between all three, and I coudl be sitting here like this until next year at this rate. So I will vid which ever one gets the most response. Then it'll be between the two remaining ones.

Option one:
Lord of the Rings - tempted!Boromir
music: Metallica's "Until It Sleeps" (song sample - 51 seconds, 813kb)

ExpandUntil It Sleeps - lyrics )

Option two:
Gladiator - Maximus
music: Loreena McKennitt's "Full Circle" (song sample - 52 seconds, 825kb)

ExpandFull Circle - lyrics )

Option three:
Farscape - seasons one and two - Crichton, Crichton/Aeryn
music: October Project's "Johnny" (song sample - 57 seconds, 901kb)

Got an interesting e-mail:

Hi,

I'm just sending this e-mail to you informing you that your Lord of the Rings Music videos "The Show Must Go On”, "Colorblind", "When I'm Gone", and "Striptease" have been nominated for a Lord of the Rings music video award. I'd like to say good luck in the voting stage (whenever it comes around), and to say that you can nominate any Lord of the Rings music videos from now until the 23rd (if you haven't already). The address is http://martoufmarty.topcities.com/LOTRawards/award.html

I know that alot of your vids are offline because of clip theft. If you aren't able to get them up for the awards... I dunno. I'm just letting you know. Actually, letting everyone know that they've been nominated. And if the category gets enough nominations, you've been nominated for Best Artist.

Well, wow. *blushing* Is indeed an honour just to be nominated.

But REALLY. Which one of you was on crack when you nominated COLOURBLIND!? *looks around*

The other three I understand. But Colourblind is shite compared to virtually every other vid I've made. Honestly now. *g*

From [livejournal.com profile] elke_tanzer, our "Mad Activist", The Webmaster of FanFlix.com has done the right thing. Too bad he couldn't have e-mailed the vidders personally. But I suppose beggers can't be choosers.

Anyway. Look, new icon. Yay! And another:

Ahh, so many icons.
ashinae: (Default)
It's all been wanked.

Complete with "but they stole the source, so it's silly that they're arguing over their illegal activities". *wipes tear from eye* It warms my heart, really.

Fannish respect, man. That's all we ask for. Just because I ripped the source off of DVDs I paid for, doesn't mean I don't have any less right to be upset than writers or artists do. Why don't people get that? Yes, some of my vids have rather long sections taken out of the moves (particularly LotR), but the rest? Sometimes don't even have much more than a handful of seconds of original editing left in them. So... shush. Just shush.

First -- [livejournal.com profile] elke_tanzer and [livejournal.com profile] elekdragon have very extensive lists of links to all pertinent info about the Desiree situation. If anyone hasn't seen, [livejournal.com profile] elekdragon has a wonderfully detailed page about this.

Second -- updated yesterday's post for details with the other three vids I found my footage in.

Third -- I responded to Desiree in that original thread. Haven't sent her anything personally in a while because both times this flared up, I have not been home, and everyone else is doing such a wonderful job for me *g* But it was about darn time.

Please respond to anything about items two and three in those threads so that I don't have to keep track of one more thread, it's crazy enough as it is *G*

For posterity, for fanflix.com -- detailed analysis of the three vids I found this week.

First: Love a Woman and Leaving Song were posted on October 26, 2003. The dates on the WMV versions of these vids are before that; will give benefit of the doubt that these were, indeed, created before all this started. Had they indeed been created between October 18th and October 26th, that, I think, would be far worse than merely not saying "Oh! Yeah, I have these OTHER vids, that I stole gratuitously from you to make. I'll be sure they don't get posted!"

I would like to call your attention to this post by another vidder I have been in correspondence with about this ().

I am sorry for making another post about this... but it is far easier than e-mailing those who need to know, plus, it will get more exposure this way!
ashinae: (Default)
Have had to edit this post...

[livejournal.com profile] elke_tanzer just fucking rocks. Thank you.

And look at this! Two more! By GUESS WHO. Yeah.

For "When You Love a Woman" (the first link), the footage of Aragorn/Arwen at 1:28? Yep, from ME. This vid was posted here on 10/26/03. HELLOOOOO anybody? POINT AND FUCKING LAUGH. I mean, this is ridiculous. And, um, at this point? I think it's just obvious which bits of Aragorn & Arwen footage in "Come What May" (the second link) is not hers. Oh, and that lower quality footage? Probably from very old vids of mine, from when I just had an illegal bootleg before the FotR EE was released. Possibly Primal Eyes, or Beautiful World, or... something.

Has anybody else used that quick shot of Aragorn and Arwen from the Two Towers trailer that was on the extended edition of Fellowship? That one of her smiling in his arms? That never made it into the movie? I don't think I've seen anybody use it but me.

Oh, and I got this e-mail from Desiree yesterday:
Hi Ashinae,
I asked you to do this before, but now I have to ask you again because I got a lot of spam on my site and people are getting annoyed by those spamers. Please remove this entry:

http://www.livejournal.com/users/ashinae/90682.html#cutid5

There are no clips any more which include your material!!!! The clips on the site are not stolen and I don't want someone to say that there! Thanks,
Désirée

I mean. She's been using my footage AFTER she got caught. And she didn't get caught for some vids, so hasn't done anything about them! Has she been paying ANY attention?

Together with me now, everybody point and laugh. On the count of three. One, two, three... *points and laughs*

Yeah, honey. No. Stop using my footage ALTOGETHER and maybe we can talk. I've pointed out how to tell which LotR clips are mine. The colour of those black mattes. If they're a kind of light charcoal grey? They're mine. Stop using them. I mean it. And the Harry Potter clips? Try watching Devil Song and Book of Days.

I owe several people replies to comments. I will get to those. I promise.
ashinae: (Default)
I'm sorry to anybody who may have already seen it -- I thought there might be some people who would want to read this, despite the fact that I don't think I'm saying anything that hasn't been seen before. But this doesn't appear to have shown up on anybody's friendslist but my own. Wonder if I accidentally set it to private? Hmm. Anyway -- here goes, one more time.

Instead of sleeping like I normally do, I spent my train ride into Toronto composing this. I considered not posting it, but, dammit, the pants don't make me feel any better, so I am typing this up and posting it. And I am not putting this behind an LJ-cut. Cope. There aren't any pictures, no quizzes. Deal with it.

I have noticed that there has been a great deal posted about fan theft in the SV fandom from [livejournal.com profile] elke_tanzer's journal. I've also come across several links to old posts about such things. There is also what I posted about two weekends ago, and the fact that Miss Desiree obviously doesn't get it.

It is entirely unlikely that any potential rat bastards lying little twerps thieves will see this rant. This makes me sad... they obviously spend enough time at our websites.

There's the idea of intellectual property. There's the idea that we, as fan artists, are stealing the original content. There is that entirely lame-assed excuse that "Well, my FRIEND gave it to me!"

Not once have I ever claimed to be Peter Jacson, JRR Tolkien, Chris Columbus, JK Rowling, or Gregory Widen (director of The Prophecy). If I was indeed any of these people, I wouldn't be doing fanvids, nor would I be writing slash (well, perhaps I would be if I was Philippa Boyens... hmm, something to ponder). Also, if I was indeed Tolkien, I'd be a bit on the dead side. Just sayin'.

This, as we all know, is why I disclaim my work -- as will any good fan. Despite the fact that anyone with half a brain knows that I am not Peter Jackson. He's been far too busy these past few years to go about making slashy Boromir vids, and besides -- he's undoubtedly far more enamoured with the character rape that is his vision of Legolas, than I am. I simply can't be Jackson.

Anyone with half a brain who has watched Fellowship, The Two Towers, Philosopher's Stone (or Sorcerer's Stone, for our American friends), Chamber of Secrets or The Prophecy a fair handful of times -- you are the people I share the vids online for -- know which bits are directly from the source material. You know and I know. I am not trying to pass these bits off as my own because that's just downright dumb. Therefore, it's just wrong of you, dear potential or current rat thief, to take someone else's vid -- in whole or in part -- and say that you edited the thing together yourself. Sure, you edited other people's vids together, but you're taking credit for other people's work. Anything that's not directly out of the movies you're working with, people are going to think you slaved over, and it's just not cool to pretend other people's hard work is your own. The same applies to art, the same applies to fic. Allow me to take one moment to discuss the people who steal hand-drawn/painted fan art and manipulate or ass that off as your own: You frelling suck donkey balls. JUst because it's not hanging in the Louvre or have a name like Da Vinci, Monet or Van Gogh on it doesn't mean it's okay to filch it for your own self-gratification, jerk. Thanks, have a good day now.

Oh, and copying and pasting fanfiction? Just so you're aware: this sucks too. I don't make this shit up. You wouldn't actually retype Harry Potter and the Philosopher's Stone, change the names, and try to get it published, would you? Of course not. Please, out of the basic decency that is supposed to be in you because you should know right from wrong -- please don't copy, paste, search and replace names in fanfiction, either. It still takes time and efford and blood and sweat and tears, even if the characters aren't ours.

Similarities in fic? Hmm, that's something else entirely. There are cliche'd situations and phrases that come up a lot. I'm almost waiting for the point where we have fanfiction author A write a story about, say, Remus and Sirius getting stuck together in, say, a broom closet, that involves the phrase "'Oh, well, shite,' said Sirius", and then for author B to use the same situation, write a completely different story, but include the same phrase. Then, author A and all her little friends going to hang author B out to dry. Or, maybe not even author A, because author A is a perfectly sensible woman -- maybe just people who read A's story. Now, I want to make it perfectly clear, that in such situations, I will not bother author B. Don't expect me to. Do expect, however, to find me pointing and laughing at everybody who is spazzing out for being, well, a bunch of silly spazzes. Mmkay?

Moving on to the old excuse "My friend gave it to me!" If your friend gave you an essay, and said, "It's okay to hand this in!" ... would you? Maybe I'm either too much of a goody-two-shoes, or way too paranoid, but I sure as hell wouldn't. Even if this doesn't hold water, why wouldn't your friend want their name attached to a full vid with these clips, or post the story, themselves? Probably because they know it's not cool for them to do so -- but hey, they get off fairly well scott-free if you do it for them like the dumbass you are, dumbass. I think, then, that it follows that your friend is a rat who obviously doesn't care if you end up with your name dragged through the mud.

You do not live under a rock. Nobody vids for a fandom if they have never seen the movie. Therefore, you know that it did not look like this in the movie. You know that somebody made the vids/clips you have. I think this makes it pretty clear that you should know it is in fact NOT OKAY to pass them off as your own work. Because you're not six. (Actually, I think I know six year olds who wouldn't do these things).

Fan artists are not movie studios. Yes, some will tell you that no, you may NOT use their work in any way, shape or form. Writers, with good cause, will ell you that no, you may not change the names of the characters and post the story as your own. Vidders may just send you copies of their source, if you need it. And yes, you'll be told no. Others will say, credit me cearly, and you may alter my art, or use a few of my clips. If they say do say no, they are not a bitch, no matter what you think. "No" is a part of every human language. You will have problems later on in life, my dears, if you don't learn how to cope with this word. It's a lovely, simple word. Embrace the "NO" and move on with your life.

You do not have the right to pass off my work as your own, and I do not have the right to pass off Peter Jackson's or Joanne Rowling's work as my own -- which is why I bloody well don't.

So grow up, okay? The world is your oyster, but there are other people and you have to share the oystery goodness. Writing and drawing are things that sometimes people just can't do. But anybody, with enough practice, can learn how to use Paint Shop Pro, Photoshop, Premiere, or any other video editing program. Teaching myself editing and Paint Shop was a difficult, long process. I am still learning. But it has been deeply satisfying to see myself improve as an artist. Even the writing took practice, I wasn't born with that ability, either. And you know something? You can experience this satisfaction too. Kind of like when your training wheels came off. Would you take away somebody else's post-training wheels euphoria and live that as your own? Of course not; you want to experience that on your own.

So don't steal that feeling from somebody else, okay? Please play nice with the other fans.

And please, from the bottom of your hearts, thank people like [livejournal.com profile] nigellus/Desiree for doing what they do -- because the vids at Drawn To the Rhythm are very likely not going back up, unless I re-edit them, because the old vids with my old source won't take watermarks. They need to be re-edited if I want the watermarks on them, and I do. (Hopefully, these thieves don't have a network, going around sending each other my un-watermarked vids.)

I am going to try to respond to some of the posts, though probably not the kerfuffly-type posts, because many of you said the things that I would have said. Thank you thank you thank you.

4) I would like to say, from whatever wisdom I have gathered in my 21.5 years, that if your "friend" takes vids that has SOMEONE'S NAME in the info section, right there, plain and clear in Windows Media Player and also in RealOne Player, and says to you "Oh, it's okay to use these!" for your own vids, your friend is a RAT BASTARD. Here goes. Will make liberal use of cut tags, as I have to, because this will be very, very long. Worth it, though, because this needs to be said. *sigh* I so had better things I could do today. Ah well. Wouldn't have taken me so long if I hadn't been trying to chat and also getting repeated phone calls from work.

Yesterday, I went out looking for HP vids, as, I have said before, I've found few that are very good. I went over to fanflix.com because they post HP & LotR vids. I saw some of the newest ones, by a vidder named Moviest@r, and downloaded two, called "Memento Mori" & "Tempora Mutantor". I noticed something about "Memento Mori" -- it uses the beginning shot of my HP vid, Book of Days. Hmm, I said. Did research, watched a bunch of her HP/LotR vids, realised, Fuck. She's stolen a lot of my stuff. Checked out the fanflix.com forum, found her LJ ([livejournal.com profile] nigellus) and web site. And her e-mail address.

Naturally, I was livid, but my dearest [livejournal.com profile] cruisedirector showed up, and became my voice of reason, and thus, I sent a very, very reasonable e-mail:

ExpandAnd I sent a note to Mr AJ Johnson about his vid )

ExpandAJ wrote me back first, here's the important part, the rest was about vidding in general )

ExpandAnd then Desiree wrote back... oy vey )

Oh boy. She has to go and LIE to me. LIE LIE LIE. *throws juvenile temper-tantrum* So, after I calmed down, I picked five of vids and did shot-by-shot comparisons to mine. Here they are, in order they appear on her site.

For all of her vids, please pay careful attention to the fact that her sources change constantly, notice the brightness of the black matte around my clips, notice how her clips about 95% of the time do not match the music/lyrics. For my LotR vids, notice the extreme brightness of my clips! Notice the dates stamped on her vids in the info, and the dates mine were created marked right on my site, and again in the vid info.

Addendum: 10/20/03. I have taken virtually all of my vids offline. All the Harry Potter vids are still up, and now watermarked, (and two NEW watermarked LotR vids), and Primal Eyes is still available. Everything else, well, it had to be done.

Addendum 10/20/03 -- Her "Times Like These" vid also uses footage from "Book of Days", and my Rings vids. Some stuff with Aragorn, others with hobbits -- the hobbits clips probably either from Hold On, or Oh Yeah.

So there we have it. Make of it what you will. I will be passing a link to this entry on to [livejournal.com profile] vidding, the fanflix forums, the host of Desiree's website, the vidder yahoo group... a few places. So that anybody else she stole from can be aware.

Desiree, hon, if you're reading this. All you needed to do was tell me the truth, and I wouldn't have done this. I take no responsibility for what anyone else may say to you. For lying, you deserve whatever you get. I know you're young, and this is undoubtedly quite unfair, but you need to understand the "unspoken" rules of fans and fandom.

Expandbehind a cut because I'm sure nobody actually WANTS to read my angry website ranting )

---

In other news, do vidders look at songvids differently than fans of songvids? Is entirely possible that I'm actually more of a FAN than a vidder.

I've been reading some interesting discussion about song choice on the vidder mailing list, and some essays that has been linked to from there. Sarah McLachlan, Enya, Loreena McKennitt, are mentioned as being over-vidded. The vidders seem to find Sarah's music wince-worthy, over-vidded and whatnot.

I've only found a tiny little handful of vids to Sarah's music. Am I looking in the wrong places? Am I not looking at vids in the right fandoms? *g* Though that may be the case, as I am only involved in a few fandoms in any way: Lord of the Rings, Harry Potter (can anybody point me in the direction of good Pottervids? Anyone? Pleeease?) and Farscape. Have not gone looking for Buffy or Angel vids as I'm too terrified of running into really mainstream music choice considering the target audience is my age *g* And I have a tape of Due South vids that has one or two Sarah McLachlan vids, but come on, her music was used on the show a handful of times, how can that be helped? Heh. Anyway, yeah.

So basically what I'm saying is, do fans of vids look at them differently? Or do you all wince and say "Not another vid to this artist/that song!" and bypass it? Or will you watch it because, yay! It's that song/that artist! Or do you give anything a chance unless you honestly well and truly despise that song/this artist? I'm curious. Because I personally will give anything a try because... well, I'm that way! I love music, and I love my fandoms, and I'll eat up darn near anything.

Any thoughts?

My vids finally have their own home! Wonderful news, yes? Yes, of course it is. *g* View the glory that is ... my vids. Here: Drawn To the Rhythm (note Sarah McLachlan song title. Am waiting for Nettwerk records to sue me (along with Dimension video, Alliance Atlantis, New Line...). Have thrown Building a Mystery's counter onto DTtR, and given BaM a new counter. Because... I can. Site stat stuff shows that the vid sections get more hits than the galleries.

Am now being forced by muses to write Boromir/Lucifer, but I imagine it'll go the way of many of my other stories... get to a certain point, and then the muses will tire of me and wander off to talk to somebody else. Ingrates, they are.

I rather would have imagined elsewhere... dunno where though *g* But, like I said, I one day wanted these quiz results to "surprise" me.

Went back to work after having three days off. Blah. Barely made it at all. Well, no, that's not true. But the place is starting to drive me mad. Just another couple of weeks, and I get my requested time off. Thank God.

And, 16 more days. 16 more days. 1-6. Sixteen. WHOOOOO!! I'm very excited. I'm going to be beside myself on the 17th.

My ticket (and Joanne's) are sitting in The Special Spot. Just... waiting. Waiting for us. And I need to go pick up Sara's, because she's coming with us, yay. *happy dance* And Jo's Steve, so I'll finally get to meet him, and Greg will be there. Sweet 'lil Greg. *g* Fun times to be had by all. I hope.

I hope Legolas and Gimli are right in this movie. Really right. I hope Helm's Deep is absolutely spectacular. I hope Arwen isn't in half the movie. I hope there's lots of Frodo and Sam goodness. I hope, I hope, I hope, that Faramir is as perfect and wonderful and gorgeous as I always imagined him to be. I need to see David Wenham in action as Faramir. I watched Molokai and thought that Wenham was spectacular, but I still need to see Faramir. Though I had some reservations about... well, a handful of the cast members, and I was only mostly right about one cast member, so perhaps I shouldn't worry. Of course, if I continue to worry, and the movie is as absolutely spectacular as I want it to be, then I can only be delighted, right? Went into Fellowship quite expecting to hate everything but Sean Bean and Ian McKellen, and ... well. Everyone who loves me knows how, ah, focussed I am on the movie *G*

Finished up the "Lament For Gandalf" vid, version 2, on Sunday afternoon. Began work on "Oh YEAH." Haven't changed it as much as I did for "Legacy", "Hold On" or "A Lament For Gandalf." Actually, I'm halfway through and I've only changed two short shots from it. This was one that I was always almost completely happy with.

Oh, and I started a new Aragorn/Boromir fic today while on break. *shakes fist impotently at Sean, Viggo, and everybody who encourages me*
